Jared Fogle, who became famous as the face of Subway’s healthy sandwiches, is back in the news. And it’s not for sandwiches. Back in 2015, it came to light that Fogle possessed child pornography and had a thing for minors.
Trying to Appeal His Sentence
Fogle, who is representing himself, has filed a motion to recuse the judge who sentenced him because she didn’t preside fairly over his case. He claims that the judge was biased against him because she “is a mother of (2) teenage daughters.” Fogle is also claiming that the judge allowed an improper conspiracy charge to be filed against him.
This isn’t the first time that Fogle has filed a motion after being sentenced. Fogle appealed his sentence to the 7th Circuit Court of Appeals, but the Court rejected his arguments in June of 2016. Fogle also filed a motion earlier this year asking the U.S. Supreme Court to take up his case. Although usually accepting a plea bargain means that a defendant loses the right to appeal his or her sentence, Fogle is permitted to appeal his sentence because the judge exceeded the prosecutor’s recommended sentence of 12.5 years in prison.
